Terms and conditions of A&A Cleaning OÜ's e-shop sale

1. The Terms and Conditions of Sale have been drafted in accordance with the model published on the website of the E-Commerce Union (https://e-kaubanduseliit.ee/alustavale-e-kauplejale/) and taking into account the principles on the processing of personal data published on the same website (see processing of personal data for more details).
2. The owner of the online shop is A&A Cleaning OÜ (registration code 16306043, location Peterburi tee 46, Lasnamäe district, 11415 Tallinn, Harju county, Estonia; phone +372 5555 444 9; e-mail info@mylove.ee ) whose online shop is located at www.mylove.ee (hereinafter mylove.ee ).

General terms and conditions

The Terms and Conditions of Sale apply to the rights and obligations arising between the customers of the mylove.ee online shop (hereinafter referred to as the Customer) and mylove.ee when purchasing goods.
When registering as a user of mylove.ee and/or purchasing products, the terms and conditions of this Agreement and the rights and obligations arising from the legislation of the Republic of Estonia shall apply.
mylove.ee reserves the right to make changes to the terms and conditions of sale and the sale prices. These changes will be reflected on the mylove.ee website.

Entry into force of the sales contract

mylove.ee sells and the Customer buys the products offered in the e-shop.
The sales contract between mylove.ee and the Customer enters into force from the date of receipt of the amount due according to the order confirmation to the current account of A&A Cleaning OÜ.
By placing an order and making a payment in the mylove.ee online shop, the Customer confirms that he/she has read and agrees to the terms and conditions of sale.

Prices

All prices in mylove.ee online shop are in Euro and include VAT 22%.
mylove.ee reserves the right to adjust prices. If the Customer submits an order before the price changes come into effect, the Customer will be charged the price that was shown on the invoice at the time the order was placed. The Customer shall not be entitled to claim compensation for the price difference.

Placing the order and paying for the goods

When paying for the order, the Customer can choose the payment method that suits them: Swedbank, SEB Bank, Luminor Bank, Coop Bank, LHV Bank, Citadele Bank, Revolut Bank Link, Inbank and ESTO by instalment or credit card. The customer pays 100% of the order amount to confirm the order.
The sales contract is deemed to be concluded and the order will be executed as soon as the Customer has paid the 100% order confirmation.
Orders that have not been paid for will be cancelled 3 days after the order has been placed.

Delivery to

After the sales contract has entered into force (payment of the invoice by the Customer), mylove.ee bundles the order and hands it over to our logistics partners for delivery.
The delivery deadlines shown on the mylove.ee website are valid from the moment of payment of the invoice.
The Client is obliged to inform mylove.ee of any change of destination immediately before the delivery of the goods.
Avoiding delays and misunderstandings in the delivery of the goods depends on the accuracy and correctness of the information provided in the order. mylove.ee is not liable for delays in the delivery of the products and misunderstandings that arise if the delay or misunderstanding is due to the inaccuracy of the information provided by the Customer when placing the order or if the delay is caused by a partner company providing transport services.

Right of return

According to section 56(1) of the LOA, the customer has the right to withdraw from the contract within 14 days of receipt of the goods.
Returned goods must be unused, undamaged and in their original packaging.
The return of the goods is at the expense of the customer, unless the reason for the return is non-conformity with the order or defective goods.
In order to return the goods, a free-form return request must be submitted by e-mail to info@mylove.ee within 14 days of receipt of the goods. The return request must include the name of the Customer, the name of the product and the invoice or order number.
The Customer will be refunded the money for the returned goods immediately, but not later than 30 days after the receipt of the cancellation. In addition to the cost of the returned goods, the delivery costs shall also be refunded.
mylove.ee has the right to withdraw from a sales contract concluded via the e-shop and to refuse to provide the service or to deliver the goods ordered in the following cases:
- Out of stock
- The price or the characteristics of the goods have been incorrectly displayed in the online shop due to a system error.

Product

Returned goods must be unused, undamaged and in their original packaging.
Cosmetics, underwear and perfumes in open packaging are not returnable. Products that cannot be checked for use (or non-use) are also non-returnable.
Goods which are not suitable for return for health or hygiene reasons and which are open after delivery cannot be returned.

Complaints procedure

According to the Law of Obligations Act, the Customer has the right to lodge a claim for non-conformity with the contractual terms of the product within 2 years from the date of receipt of the goods, of which the first 6 months, the defect is presumed to have existed at the time of purchase and the nature of the defect must be determined by the seller.
In the event of a defect in the product, the Customer undertakes to notify mylove.ee of the problem by e-mail to info@mylove.ee and to provide the following information: name, contact details and the product is missing. The corresponding statement must be sent no later than 2 months after the discovery of the defect.
mylove.ee is not responsible for:
- For damage to the product caused by the customer's fault or negligence.
- Defects resulting from improper use of the product.
- For natural physical wear and tear of the product under normal use.

Liability and force majeure

mylove.ee shall be liable to the Customer and the Customer shall be liable to mylove.ee for any damage caused to the other party by breach of these Terms and Conditions in the cases and to the extent provided for by the legislation in force in the Republic of Estonia.
mylove.ee shall not be liable for any damage caused to the Customer or for any delay in the delivery of the product if the damage or delay in the delivery of the product is due to a circumstance that mylove.ee could not have foreseen.

Privacy

By using the mylove.ee website, the Client gives its explicit and informed consent to mylove.ee to process its personal data.
mylove.ee will use the information provided by the Customer only for the purpose of fulfilling the Customer's purchase order and will not disclose it to any third parties (except for payment processors and transport service providers).

Disputes and other conditions

Any disagreement or dispute arising out of these Terms and Conditions shall be resolved by the parties, in particular by negotiation. In the event that disputes arising out of the Contract cannot be resolved by negotiation between the parties, the Customer shall have the right to seek redress before the Consumer Protection Board or the Court. mylove.ee shall have the right to seek redress before the Court.
